Markaz Afiliator Terms of Service

This is an English translation of the Indonesian version (Bahasa Indonesia). If the two versions differ, the Indonesian version prevails.

These Terms of Service ("Terms") govern the use of the Markaz Afiliator app, the markazafiliator.com site, and the SME Shop pages (together, the "Service"), operated by Ahmad Rosida ("Developer", called Admin inside the App). By registering or using the Service, you confirm that you have read, understood, and agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

1. What the Service is

• The Service is a record-keeping tool for affiliate promotion teams: Boss accounts publish promotion tasks or products, Worker accounts share them and send proof, and the Service records reports, commissions, bonuses, and salary payments. The SME Shop provides web pages so buyers can order directly from the seller (the Boss).
• The Developer is not the Workers' employer, not an agent, and not a party to any work agreement between a Boss and a Worker. Wages, working arrangements, and payments are set by, and are the responsibility of, the Boss and the Worker.
• The Developer does not receive, hold, or forward money, whether salaries or buyers' payments. Salaries are transferred directly by the Boss to the Worker, and buyers pay the seller directly. The Developer is not a party to SME Shop sales.
• The Service is not affiliated with Shopee, Tokopedia, TikTok, Lazada, DANA, WhatsApp, or any other marketplace/platform, and does not guarantee any income.

2. User and account requirements

• You must be 18 years or older and legally competent. Accounts belonging to minors will be deleted.
• The data you enter (name, phone number) must be true and your own. One account is for one person; using someone else's identity, creating fake accounts, or selling/lending accounts is prohibited.
• You are responsible for keeping your password secret and for all activity in your account.
• Bosses and Workers handle their own tax obligations on their income, wages, commissions, and sales under the tax regulations.

3. Boss obligations

• Pay approved salaries, commissions, and bonuses in the recorded amounts, and upload genuine transfer proof.
• Comply with the terms of the affiliate programs you join (for example the Shopee Affiliate Program) and the rules of the platforms where tasks are shared. Many affiliate programs prohibit mass sending (blasting/spam), sending the same content repeatedly to the same audience, placing links on unregistered accounts, misleading content, and posing as the marketplace itself; violations can lead to withheld commissions or blocked affiliate accounts. As the affiliate account owner, you are responsible for the promotion methods you ask of your Workers. The Developer is not responsible for account blocks or withheld commissions by marketplaces.
• Only publish tasks and products that are lawful, accurate, and do not infringe others' rights (including photo copyright and trademarks).

4. Worker obligations

• Do tasks honestly and send genuine proof; fake, edited, or duplicate proof is prohibited.
• Share tasks only to contacts, groups, or accounts that allow promotion, do not send repeatedly to the same group, and follow the rules of the target group and platform.
• Workers never need to pay anything to use the Service or to get tasks. A Boss or anyone else who asks you to pay a deposit, registration fee, "top up", or to buy products in order to work is not part of the Service and is likely a scam. Do not pay, and report it to the Admin via the 💬 Chat menu.

5. Prohibited activities

No user may use the Service for:

• fraud, including asking Workers for deposits/fees, promising guaranteed income, investments or "paid tasks" that require payments, pyramid schemes, chain schemes, or income from recruiting other people;
• gambling, illegal online lending, unlicensed investments, money laundering, or other activities that violate the laws of the Republic of Indonesia;
• spam, mass sending to people who have not agreed to it, or misleading promotional content;
• pornographic or violent content, hate speech, hoaxes, harassment, threats, or content that infringes intellectual property rights;
• disrupting or breaking into the system, using bots/automated scripts, or trying to access other users' data;
• selling prohibited goods or services (see section 6).

6. SME Shop

• The seller (Boss) is fully responsible for products, descriptions, prices, stock, shipping, warranties, and buyers' rights under the Consumer Protection Law, and for their own business licences and taxes.
• Prohibited items: narcotics and prescription drugs without a licence, drugs/cosmetics/food without required BPOM registration, e-cigarettes and tobacco products, alcoholic drinks, weapons, explosives, protected animals/plants, counterfeit or pirated goods, stolen goods, adult content, financial/investment products, gambling credits/vouchers, and any other goods prohibited by law.
• Buyers pay the seller's bank/DANA account directly. The Admin reviews buyer complaints only to decide the order and commission status in the Service; refunds are a matter between buyer and seller.

7. Paid plans

• Paid plans for Boss accounts last 30 days from activation, with the quotas shown in the App. When a plan ends, the account returns to the Free plan without losing data.
• Purchases through Google Play follow Google Play's refund terms. For plans activated by the Admin, cancellation or refund requests are made via Admin chat and decided fairly, including when the Service was disrupted by the Developer's fault.

8. Disputes and the Admin's role

• When a Worker rejects salary payment proof or a buyer files a complaint, the Admin may review both parties' evidence and set the status of the record in the Service (for example, whether a payment counts as completed). This decision concerns only the records in the Service, is not a legal ruling, and does not prevent either party from taking legal action.
• The Admin may warn, hide content, suspend, or delete accounts that violate these Terms, and may hand data to law enforcement when required or lawfully requested.

9. Limitation of liability

• The Service is provided "as is". The Developer works to keep the Service running and secure but does not guarantee it is always available or free of disruption.
• To the extent permitted by law, the Developer is not liable for losses arising from other users' actions (for example unpaid salaries, fake proof, undelivered goods), from third parties (marketplaces, banks/e-wallets, mobile operators), or from use of the Service in breach of these Terms. The Developer's liability, if any, is limited to the plan fees you paid in the last 30 days.

10. Ending use

You may stop and delete your account at any time (see Delete Account). Accounts not opened for 60 days are deleted automatically under the Privacy Policy. The Developer may discontinue the Service with notice in the App.

11. Changes to the Terms

These Terms may be updated. Important changes are announced in the App and must be accepted to keep using the Service.

12. Governing law

These Terms are governed by the laws of the Republic of Indonesia. Disputes are first settled amicably through the Admin; failing that, through the competent courts or dispute resolution bodies in Indonesia.
